INDUSTRIAL DESIGNSTHE REGISTRATION PROCEDURE
The application shall be registered with the National Registry for Inventionas and Trademarks. The application for the registration of an industrial drawing/model includes the identification data of the applicant (petitioner), together with a description that must consist exclusively of the specific elements of aesthetic appearance, as well as new elements, that can also be found in the graphic representations, attached to the application. The registration certificate of the industrial drawing/model shall be issued by the General Manager of the State Office for Inventions and Trademarks and it shall be registered with the National Registry for industrial drawings/models. These documents will be filed at the State Office for Inventions and Trademarks and they shall constitute the so-called national deposit of industrial drawings/models. THE REGISTRATION COSTS
By Law No. 381/2005 for the amendment and completion of Government’s Ordinance No. 41/1998 regarding taxes in the field of industrial property protection and their utilization conditions, which came into force on January 7th, 2006, the registration costs of the national industrial drawings/models have been changed. The costs consist of:
- the registration tax (must be paid when applying): RON 108 (EUR 30); - the tax for publishing the drawing or model in the Official Gazette for Industrial Property (OGIP), Industrial Drawings or Models section: - for black and white solid picture –RON 72 (EUR 20); - for a color solid picture – RON 360 (EUR 100); - for specific elements - RON 36 (EUR 10). - the examination of the grounds of the request tax for the first industrial drawing/model (to be paid within month from the payment date): RON 180 (EUR 50); the tax for each additional industrial drawing/model is of RON 36 (EUR 10) - the tax for issuing the certificate for 1-20 industrial drawings/models (within one month from the communication of the acceptance decision): RON 72 (EUR 20) Throughout the validity period of the industrial drawing/model, the holder shall pay certain taxes for keeping the registration certificate in force. Should the holder fail to pay such taxes, it shall lose its right from registration. |
