We would like to inform you that the Romanian Trademark Law has substantially changed and the changes will be applicable staring with May 9, 2010.

The most important change refers to the fact that starting with 09 May, 2010 the Romanian Patent Office will not check any more, during the registration procedure of the newly filed trademarks,  whether there is or not, a previously registered similar trademark.

It will be the duty of the trademark’s owners to check the newly published trademarks, in order to file oppositions to the registration of the newly filed similar trademarks in 2 months from their publication. 

In other words, becomes imperative to supervise your trademarks in all the databases: of national trademarks, community and international trademarks.

 

Furthermore, we recommend you to take steps to use, keeping evidences of such use, your registered trademarks in order to substantiate, if requested by the applicant of the new trademark, the evidences of use of the trademark in the last 5 years from the filling date of the new trademark.

Please note that TEODORU & ASSOCIATES offers on that supervision service at the price of:
- 50 EURO/ trademark/ month for checking the trademarks in classes in which they are  registered;
- 80 EURO/ trademark/ month for checking the trademarks for all the products and goods, in order to block in due time and with lower expenses through the new procedures of observations and oppositions, potentially identical or similar trademarks.

For the clients with large trademark portfolios there is the possibility of volume discounts.
